By accepting an appointment time and date at SMK Studios via written correspondence you, the client, automatically agrees to the terms and conditions of SMK Studios unless otherwise specified upon booking inclusive of being automatically added to our mailing list.

Booking Fee and Rescheduling

Here at SMK Studios a non-refundable retainer fee of €50 per photography session (wedding events excluded- please see Wedding specific contractual information) is required to hold you offered appointment date and time.  All retainers must be paid within 48hours of initial enquiry to confirm your booking or your offered appointment date will be released. Christmas mini sessions retainer booking fees are also non-refundable.

If we are notified at least 48 hours prior to your session that you wish to cancel (cancellation reason required) then you will be given a credit note for your full booking fee amount which will be valid against re-booking or against studio products for a certain period of time.

All appointments are given a designated time slot. If you do not alert SMK Studios to the possibility of a late arrival, and you arrive 15 minutes after your designated appointment time, your appointment will be cancelled and booking fee/retainer not reimbursed. A new appointment may be made at the discretion of SMK Studios but full payment of same will be required, including a new retainer fee on the day of making the new booking.

If booking a session with the intention of using a gift voucher, - a reimbursable booking fee will be required to hold the session. If session is rescheduled more than twice, all booking fees will be retained.

All packages must be paid for in FULL prior to the package being created.

All studio shoots must be paid in FULL on the day of shooting. Add-ons/Custom building of packages post same is acceptable once the account has been settled.
All (additional) accounts must be settled within one month of appointment/event or an incremental fine will be applied of €20 per unpaid week. If the account continues to go unpaid for more than 3 months, with penalty application, the customer will be referred to a debt collector at their expense. All portraiture packages must be chosen within 4 weeks of receiving your online gallery. if not chosen by this time you will be charged an incremental fee. Portraiture packages will be completed and ready for collection within one month of selection.

All packages must be chosen within one month of receiving your online gallery. If these choices are not made (with follow up) within three months of receiving the gallery then SMK Studios has the right to close out this case without creating any print package or apply a late penalty fee depending on the timeframe lapsed. This is at the discretion of SMK Studios.
In relation to all event photography, - imagery is securely kept for 12 months. Customers may have the opportunity to reorder after 12 months at the discretion of SMK Studios, but it is not guaranteed. Studio & Wedding photography imagery is kept for up to 5 years in a secure destination only accessible by SMK Studios.

While booking newborn portraiture or any mini session please be aware that these are specialized services and family members will not be permitted to partake unless prior arrangements made with SMK Studios.

If a specialised appointment is booked, for example a birthday cake smash and the child who is the main model of the shoot does not cooperate or is unable to complete the shoot due to poor mood/obvious distress it is at the discretion of SMK Studios whether to cancel the shoot on the spot, withholding any retainers given or offer a rescheduling of the appointment. Rescheduling of the appointment will be based solely on SMK Studios availability and willingness to work the client. If the shoot has been partially completed, it is at the discretion of SMK Studios to offer a repeat mini session of the shoot free of charge once the original package has been paid in full. A similar value shoot may be offered, i.e. a family portrait session in exchange for a birthday cake smash on the day and if this is completed accordingly, SMk Studios may decide not to offer the min session complimentary studio session. If the value of the original shoot has been completed within the original appointment slot, the client has no right to ask for a refund or rescheduling unless anew appointment is to be booked and paid for in full.

SMK Studios offers online gallery imagery as part of some basic packages due to customer demand. Please beware that external printing of these images at a non-recommended printing lab sources (such as photobooths/one hour photolabs) is out of SMK Studios jurisdiction and we cannot be liable or responsible for the printing quality of such imagery. SMK Studios recommends the use of our personal printing services which guarantee the highest print quality available for the image, and which is offered with every print package. If you have decided upon a wall art/print package, the final creation of said wall art must be chosen within 3 months of your shoot and collected within two weeks of completion email notification. After this time a penalty fee will be added to your account.

Copyright and Reproductions

SMK Studios by Sarah Kilduff Photography (The Photographer) shall own the copyright on all images created and shall have the exclusive right to make reproductions and edits of any kind. The Photographer shall only make reproductions for the Client or for the Photographer’s portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, editorial use, website, or for display within or on the outside of the Photographer’s studio.

Return policy

No refund of retainers will be given under any circumstances if you fail to attend your appointment on the day and at the time listed, when the booking was made or if you cancel with any reason outside those listed within our cancellation policy. Due to the nature of digital photography and the fact the photographs, once sent, cannot be returned, SMK Studios has a no refunds policy. Once a transaction has been completed it is then considered non-refundable. Due to the custom aspect of these services, there are no refunds on any designed order, this is inclusive of print package creation.

Gift Vouchers are non-refundable and only transferable if discussed directly with SMK Studios prior to doing so.

In order to authorise Sarah Kilduff photography to photograph (you or) your child, in your presence, if under the legal age of 18, to ensure willing and non-coerced photography services. SMK photography reserves the right to refuse photography to a participant if they feel they are uncomfortable or coerced in any way for the greater good of the child in accordance with the welfare of children act. SMK photography also reserves the right to maintain digital copies of all photography taken on the day for up to 5 years, to ensure client satisfaction and repeat production, after which they will be destroyed unless prior arrangement made.

I allow/do not allow SMK Studios to use all photography taken for advertising purposes. It is against SMK Studio rules to alter or change photographs purchased either physically in print or online. If an image is found on social media and is edited beyond what SMK Studios has provided to the client in the final package then this is a breach and action will be taken. This is a serious act and will not be taken lightly.

If accidental/purposeful damage occurs to any equipment/stock/premises/persons during said photo-shoot, it is at the responsibility of the client/parents/guardian and full reimbursement of costs will be expected on the day of the issue. If the issue cannot be resolved on the day, legal action will ensue.

If at anytime, SMK Studios does not feel comfortable photographing a minor due to disruptive behaviour causing accident or damage, you will be asked to leave the premises and deposits are non-refundable if damage occurs.

If cancellation due to unforeseen events occurs, it is at the discretion of SMK Studios to return your retainer based on previously stated T&C’s. 48 hours notice is required for cancellation of all appointments/event photography.

All T&C’s are applicable and can be discussed privately with SMK Studios by appointment.

Privacy Policy

Your privacy is important to us. We provide this notice to explain our online information practices and the choices you can make about the way your information is collected and used. This notice applies to all information collected or submitted by SMK Studios through electronic/paper methods.

The only personal information we collect is name, address, email address, and telephone number. Your credit card information will also be collected if that form of payment is used to make your purchase but, that data is only used to process your transaction is not stored in our database.

We use the personal information collected from you to facilitate taking your photographs, communicating with your regarding your photographs and other related products and services, and processing any transaction you may do with Birch Arrow Photography. Such personal information as we collect is not used for any other purpose and is not shared.

We never use or share the personally identifiable information provided to us online in ways unrelated to the ones described above.

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put into place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online.

Protecting the privacy of the very young is particularly important to SMK Studios. Parental/Guardian written consent is required for all photography services involving minors as per GDPR and the Children of information Act.

You can correct factual errors in your personally identifiable information by sending us a request detailing the error(s). To protect your privacy and security, we will also take reasonable steps to verify your identity before granting access or making corrections. In the unlikely event any of the personal information you supply us online is misused, you may redress these issues by contacting us by email.
